TERMS AND CONDITIONS (JADA Education Package Website)
Please read the following terms and conditions (the 'Terms of Use').
The purpose of the JADA Education Package website is to provide you with information to help enhance teaching and learning about values of sport and Anti-Doping rules at schools, sport club and other places of formal education.
References to ‘we’, ‘us’ and ‘our’ should be construed as references to the Japan Anti-Doping Agency (‘JADA’).
1. AGREEMENT TO USE
We provide you with access to our website at https://www.playtrue2020-sp4t.jp/edu_package (the ‘Site’) subject to the following Terms of Use. We reserve the right to change the Terms of Use at any time without notice. Access and use by you of the Site constitutes acceptance by you of the Terms of Use in force at the time of use. The Site is owned and operated by the JADA whose address is currently at c/o Japan Institute of Sports Sciences 1-12-14 Koishikawa, Bunkyo-ku, Tokyo, 112-0002 JAPAN.
2. AMENDMENTS
We reserve the right to update or otherwise change these Terms of Use at any time without notice. Please review these Terms of Use regularly to ensure that you are aware of such changes. Your continued use of the Site after such changes are made indicates your agreement to be legally bound by the updated Terms of Use.
3. COPYRIGHT AND INTELLECTUAL PROPERTY
All information, data, text, documents, graphics, logos, designs, images, pictures, photographs, videos, podcasts, weblogs, software, interactive features or any other content, services or materials (and any part of them) accessible on the Site (the ‘Materials’) are protected by copyright, trademarks and other intellectual property rights and are the proprietary materials of the JADA and we reserve all rights that are not specifically granted under these Terms of Use. Except where it is otherwise indicated as acceptable on the Site, you may not reproduce, modify, adapt, post, transmit, copy, make available or distribute or otherwise use any of the Materials on this Site without the prior written permission from JADA. Any use made of such Materials may be an infringement of rights in those Materials and the JADA reserve all rights to enforce such rights.
You may read, view, print and (where permitted) listen to and download the contents of an individual page for use within a formal education setting only provided that all copyright, trademark and other proprietary notices contained in the Materials on any copy of these Materials is retained, but you may not recopy or further distribute, sell, publish or transmit any part of the Material by electronic or any other means.
You agree not to sell, resell, supply or otherwise make the content contained on the Site or extracts or other information derived there from available in any manner or on any media to any third party without the prior written consent of the JADA. Requests for written approval should be emailed to us. Please give details of your intended use of the Material and include your contact details: your name, address, telephone number, fax number and email.
4. LINKING POLICY
Linking to us: We encourage users to establish hypertext links to the Site.
Links from us: We restrict links made from the Site to other sites to certain associated and supporting organisations.
Links to us and from us are provided at our absolute discretion and may be altered, or removed from your website, by us at any time. You may not use any link to the Site as a method of creating an unauthorised association between an organisation, business, goods or services and the JADA, and agree that no such link shall portray us or any other official JADA organisations (or our or their activities, products or services) in a false, misleading, derogatory or otherwise objectionable manner. The use of our logos as a link to the Site is strictly subject to our prior written approval.
We are not responsible for the contents or reliability of any site to which it is linked and does not necessarily endorse the views expressed within them. Linking to or from this Site should not be taken as an endorsement of any kind. We cannot guarantee that links will work all of the time and we have no control over the availability of the linked pages.

or in any way that might bring the JADA or JADA Education Package into disrepute. This list is not exhaustive and may be amended by us from time to time. We may at our option, but without the obligation to do so, monitor communications transmitted via this Site and remove any unlawful or offensive Material.
You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us as a result of breach by you of these Terms of Use or any applicable laws.
7. LAWS OF JAPAN
These Terms of Use shall be governed by, and interpreted in accordance with, the laws of Japan, whose courts shall have exclusive jurisdiction over any dispute, claim or matter arising under or in connection with these Terms of Use.
8. PRIVACY POLICY
The information that you provide about yourself to the JADA will only be used by us in accordance with our Privacy Policy and by using this Site you consent to use our data collected on this Site in the manner set out in the Privacy Policy. We may use cookies on the site (see our Privacy Policy for further details).
9. MISCELLANEOUS
These Terms of Use and all documents and legislation referred to herein constitute the entire agreement between you and us regarding your use of the Site. If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect.
Failure by either party to exercise any right or remedy under these Terms of Use does not constitute a waiver or abandonment of that right or remedy. The section headings in these Terms of Use are for convenience only and will have no legal meaning or effect.
We shall not be responsible for any breach of these Terms of Use caused by circumstances beyond our control.
These Terms of Use do not create or infer any rights that are enforceable by any person who is not a party to these Terms of Use. You may not assign, sub-licence or otherwise transfer any of your rights and obligations in these Terms of Use to any other person.
